Lotte asks court to dismiss DFS lawsuit

According to a formal statement today, Lotte Duty Free Guam has moved a legal motion for the dismissal of DFS Guam’s Procurement lawsuit.
This latest development in the battle for the Guam duty free business follows the Guam International Airport Authority’s decision to move forward with its duty free award to Lotte Duty Free Guam, despite DFS Group’s pending legal action [see previous story and full details as written on June 11].
Lotte is now arguing that the court should find DFS’ action ‘frivolous and without merit’ – and outside the court rules. It is also maintaining that DFS’ case is somehow weakened in terms of legal standing as DFS was not the second highest bidder, although why this should be relevant remains unclear.
In essence, Lotte is therefore asking the Superior Court to dismiss the entire complaint, although this request has not been heard yet and no hearing has been set in response to the said request for Lotte’s ‘Motion to Dismiss’.
Meanwhile, Lotte Duty Free is continuing with its plan to take over the airport shops on the appointed date of July 21 and the Pacific News Center website reported today that the retailer is apparently holding a ‘job fair’ this Friday [June 21] at the Hilton Guam Resort and Spa between 10.00am and 1700.
